• I understand and agree that my application for financial transaction(s) will be processed at the applicable NAV subject to realization of clear funds and acceptance of transaction by the CRAMC/Authorised Registrar in terms of the SID/ SAI. The electronic time stamping on the transaction request received by the CRAMC/Authorised Registrar shall be deemed to be the time stamping in accordance with SEBI Regulations. The time and date recorded will be treated as the time and date of submission of the said online application (electronic application);
• I agree and confirm that if at any stage it is found by CRAMC/ Authorised Registrar that the information provided by me is incorrect/ false/ erroneous, CRAMC/ Authorised Registrar may at its sole discretion reject allotment of Unit/s and such decision shall be final and binding on me;
• I have neither received nor been induced by any rebate or gifts, directly or indirectly in making this investment. The ARN holder, (where selected for the transaction) has disclosed to me/ us all the commissions (in the form of trail commission or any other mode), payable to him for the different competing Schemes of various Mutual Funds from amongst which the Scheme is being recommended to me/us;
• I understand that all correspondence/communication in respect of my folio(s) will be sent by CRAMC/ Authorised Registrar at the registered address and/or email address provided by me.
• I understand that if the Unitholder is a minor, then the facility can be availed of by his/her parent or by a legal guardian appointed by a court of competent jurisdiction on behalf of the minor. I as the parent/ legal guardian shall represent the minor in all transactions of any description until the said minor attains majority. Upon attaining of majority, my right as the parent/ legal guardian to operate the account(s) shall cease. I as the parent/ legal guardian agree to indemnify CRAMC against any claim/s of the above minor in respect of any transactions made by me on behalf of the minor.
• I agree that the CRAMC/ CRMF has sole discretion at any time to restrict a particular set/ class of investors from purchasing/subscribing to/ dealing with the units of CRMF.
• I agree that at present the said Facility is a privilege service offered without any charges. However, CRAMC may levy any service charges as applicable from time to time in consideration for the services provided herein.
• I understand that the pages within the Website may contain supplemental Terms and Conditions and additional disclosures and disclaimers, which are in addition to these Terms and conditions, disclosures and disclaimers.
• I agree that CRMF/ CRAMC is providing the said Facility to the investors on a best effort basis. While due care has been taken to ensure accuracy of information on the Website, the CRMF/ CRAMC, the Sponsors and the RTA shall not be held liable and responsible for any loss, damage or other costs arising in any way out of:
  • Any force majeure circumstances beyond its reasonable control including but not limited to any network errors, delay or loss of data, acts of God, floods, epidemics, quarantine, riot or civil commotion and war or such like circumstances;
  • System failure including failure of associated systems, or fluctuation of power resulting in interruption or delay in the provision of this service;
  • Neglect, misuse, errors, frauds of the investors or agents or any third party or due to any other eventualities;
  • Any fault in any attachments or associated equipment of the investors;
  • Any incidental, indirect, special or consequential damages including but without limitation, loss of profit;
• I hereby acknowledge that I am utilizing the said Facility at my own risk. These risks would, among others, include the following:
  • The Internet per se is susceptible to a number of frauds, misuse, hacking and other actions, which could affect the Instructions to CRMF/CRAMC/RTA. Whilst CRAMC shall aim to provide security to prevent the same, there cannot be any guarantee from such Internet frauds, hacking and other actions, which could affect Instructions to CRMF/CRAMC/RTA. The user shall separately evaluate all risks arising out of the same.
  • The technology for enabling the services offered by CRAMC could be affected by virus or other malicious, destructive or corrupting code, program or macros. This could result in delays in the processing of Instructions or failure in the processing of Instructions and other such failures and inabilities. The User understands that CRAMC disclaims all and any liability, whether direct or indirect, whether arising out of loss of profit or otherwise arising due to any failure or inability by CRAMC to honor any user Instruction for whatsoever reason. The User understands and accepts that CRAMC shall not be responsible for any of the aforesaid risks. The User also accepts the disclaimers made by CRAMC concerning any liability in respect of the said risks.
• I undertake and warrant to not to make any unauthorized usage of the Website including but not limited to the following:
  • Transmitting or sending unsolicited commercial or marketing communications;
  • Deleting or revising any content;
  • Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Website;
  • Aggregating, copying or duplicating in any manner any of the contents or information from the Website;
• I represent and warrant that I shall not host, display, upload, modify, publish, transmit, update or share any information that-
  • Belongs to another person and to which I do not have any right to
  • Is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling or otherwise unlawful in any manner whatsoever;
  • Harms minors in any way
  • Infringes any patent, trademark, copyright or other proprietary rights
  • Violates any law for the time begin in force
  • Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature
  • Impersonates another person
  • Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource
  • Threaten the unity, integrity, defence, security or sovereignity of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of offence or is insulting any other Nation
• I agree to use the said Facility for legitimate and lawful purchases only, and in accordance with the applicable legal provisions. I shall not use the said Facility to make any speculative, false, or fraudulent purchases. I shall not use the said Facility for any activity which breaches any law or regulation or in a way which interferes with its availability to other users. I agree to indemnify CRAMC/ CRMF and its directors, Trustees, employees, agents and representatives against any liability, costs, loss, or damages arising out of any disputes, claims or suits on account of such unauthorized access or use of the said Facility.
• I understand that CRAMC may, at its absolute discretion, alter, suspend or terminate any of the services under the said Facility completely or partially or prohibit or restrict access to the Websites without any notice to the User/Unit holder and without assigning any reasons thereof. CRAMC reserves the right to change these terms and conditions or withdraw the said Facility at any time, without any notice or liability or any prior approval. The investor is required to read the terms and conditions regularly. Usage of the said Facility by me shall be deemed as my express acceptance of these terms and conditions including changes made therein from time to time.
• CRMF / CRAMC retains all rights (including copyright, brand name, logo and intellectual property rights) with respect to all software and underlying information and material available through the said Facility. The User is prohibited from downloading or otherwise exporting or re-exporting or using any software or underlying information or material available through the Website (in part or in whole) except with the written permission of CRAMC and in full compliance with all applicable laws and regulations, save and except such downloading / usage which occurs in the course of using the said Facility.
• I understand that payment for the transaction shall be through a payment gateway and the CRAMC/ CRMF/ Authorised Registrar will not be liable for any failures in the link or for any fraud (either at the payment gateway's end and/or the bank's end) that could take place at the time of making payment and I undertake to inform either CRAMC or the Authorised Registrar immediately in case my bank account is debited but corresponding Units are not allotted to me.
• I understand that it will be my sole responsibility to ensure that the PIN is kept confidential and not revealed / disclosed to any third party, including any person claiming to represent the CRAMC, CRMF or Authorised Registrar and I agree to take all possible care to prevent discovery of the User name or PIN by any unauthorised person or a third party. I agree to commit the password to memory and not record them in a written or electronic form and shall not let any unauthorized person to have access to the computer or leave the computer unattended while accessing the Website. Any disclosure thereof to any other person for any reason whatsoever, including for the service of family portfolio, or disclosure to any distributor(s) for conducting any transactions, shall be entirely at my risk.
• I understand that the following person/s shall use the said Facility:
  • Only existing investors with registered email IDs can avail of the said Facility. Email ID provided in the PIN Application Form will supersede the existing email ID in the records of CRAMC/ Authorised Registrar.
  • If the mode of holding is 'Single', the sole User.
  • If the mode of holding is 'Anyone or survivor' or 'Joint', the PIN will be available to the Sole / First Unit Holder. The Unit Holder(s) of such account agree(s) and confirm that the CRAMC / Authorised Registrar shall not be in a position to verify the User of the Website and thereby not be responsible or shall not be liable for any transactions arising out of misuse of the PIN by any of the Joint Unit Holder(s). Use of the PIN for any transaction executed by any of the Joint Unit Holder(s) under the said Facility shall be deemed to have been carried out jointly by all the Joint Unit Holder(s). The Joint Unit Holder(s) agree and confirm that the First Unit Holder has the full authority to act for and on behalf of all and each of the Joint Unit Holder(s) in all matters relating to the said Facility. Liability in respect of joint holding shall be joint and several and shall be binding on each Joint Unit Holder, his/her legal heirs, successors, executors and assigns. The Joint Unit Holder(s) hereby agree and undertake to confirm and ratify all the acts done by the first Unit Holder or any other Joint Unit Holder in relation to the said Facility.
  • If the User is a minor, the parent / legal guardian shall be eligible to avail the said Facility till the minor attains majority. In such case, the personal details of the parent / legal guardian shall be submitted to the CRAMC / Authorised Registrar. The parent / legal guardian hereby agrees not to use the said Facility once the minor attains majority.
  • If the User is not an individual, the authorized signatories (as mentioned in the application form at the time of subscription to Units or subsequent changes in the authorised signatory list).
    • The User may designate any individual as its authorized user by providing to CRAMC/ Authorised Registrar the followingThe relevant resolution or authority, as the case may be, to subscribe to Units, in original or a duly certified true copy thereof.
    • Such resolution or authority shall state the name of the individual/s authorised to apply for, receive and activate the PIN access to the said Facility on behalf of the User and to further receive from, and send to, any and all communications with CRAMC/ Authorised Registrar with respect to the said Facility.
    • The said resolution or authority in favour of such individual/s shall also contain the specimen signature of the individual/s so authorised.
    • It shall be the User's responsibility to communicate any changes to the said authorised person/s in the same manner as aforesaid.
    • The Non-Individual User agrees and confirms that CRMF/ CRAMC/ Authorised Registrar is not in a position to verify the User of the Website and thereby not responsible or shall not be held liable for any transactions arising out of misuse of the PIN by any of the representatives of such Non-Individual User. Any use of the PIN for any transaction executed by any Non-Individual User under the said Facility shall be deemed to have been carried out by the Non-Individual User. The Non-Individual User agrees and confirms that the said authorised person/s has/have the full authority to act for and on behalf of the Non-Individual User in all matters relating to the said Facility. Liability on all such Non-Individual User accounts shall be binding on each of such Non- Individual User's successors, executors and / or assigns. The Non-Individual User hereby agrees and undertakes to confirm and ratify all the acts done by the authorised person/s or any other person claiming to be authorized by the Non-Individual User in relation to the said Facility.

• The said Facility is not available to User/s whose original signature/s is/are not registered with the CRAMC/ Authorised Registrar. CRAMC reserves the right to reject any PIN Applications received from such User. The said Facility is intended only for personal non-commercial use of the User. If any User chooses to access / use the said Facility from locations outside India, he/ she/ it does so at its own initiative and risk, and shall be solely responsible for compliance with all applicable laws in force in the respective locations/ jurisdictions outside India.
• The Website is intended for use by such investors, prospective investors and distributors authorized by law and regulations to invest/deal in Mutual Fund units. The Website is not intended for distribution, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.
• CRAMC/ Authorised Registrar may, at its absolute discretion and in the interest of the User, request document/ confirmation with regard to online transaction, signed by the User. However, CRAMC/ Authorised Registrar shall have no obligation to check or verify the authenticity or accuracy of document/ confirmation/s purporting to have been sent by the User and may act thereon as if the same had been duly given by the User.
• CRAMC/ Authorised Registrar shall not be responsible for any errors that may be committed by the User in the process of executing any transaction on the said Facility. The User shall make only one application for each transaction, either in physical or electronic form.
• The User shall give the CRAMC/ Authorised Registrar ten (10) working days' notice in writing if the User wishes to terminate this facility. CRAMC/ Authorised Registrar is entitled to terminate the PIN without prior notice on the occurrence of any of the following events:
  • Non-compliance of the terms and conditions set out herein.
  • Death, insolvency, bankruptcy or liquidation of the User.
  • Any other cause arising out of operation of law.
  • Closing of User's account.
  • Receipt of a letter from a Joint Holder for termination of the said Facility.
  • If the User goes into liquidation or dissolution or presents or is presented with a petition for or passed a resolution for winding up either compulsory or voluntary or makes any arrangement with its creditors or any assignment for the benefit of creditors, or if a receiver or manager of its business or undertaking is duly appointed, or if distress or execution shall be levied or threatened upon any of its property or if it suffers any similar action in consequence of debt.
  • Such other reasons as CRAMC/ Authorised Registrar may deem proper in the interest of the User.
• The User authorises CRAMC/ Authorised Registrar to provide to third parties such details relating to the User and / or the User's account as may be necessary in order to give effect to any electronic instructions of the User or in order to comply with the order of any court, governmental/statutory agency or lawful authority or in order to ensure compliance with any laws / regulations in any jurisdiction.
• The information and materials contained on the Website, and the facility interface, including text, graphics, links or other items - are provided on "as is" and "as available" basis. The use of the Website may be monitored, tracked and recorded. The CRAMC or the Authorised Registrar do not warrant the accuracy, adequacy or completeness of the said information and materials and expressly disclaims its liability for errors or omissions in the said information and materials. • These Terms and Conditions will be governed by Indian laws and the Courts in Mumbai shall alone have jurisdiction. In case of dispute, the matter will be settled by arbitration as per the rules of Indian Arbitration and Conciliation Act, 1996. Any member of Management Team of CRAMC or its nominee shall be the sole arbitrator and the place of arbitration shall be Mumbai.
